How Many Cases Must A Good Constitutional Lawyer KNOW?

I’m trying to put together a list of constitutional court cases which the next coupla generations of legal-types and citizens would do well to know. My presumption is that U.S. legal precedentry is getting both ancient and large enough to produce a growing dichotomy between the decisions important as “history,” and those actually directly relevant to the cases being fought-out in the 21st century.

Many of those big decisions from the first two hundred years of the Republic have been superceded by amendments, new laws, new technologies, or by relatively recent judicial opinions. Lawyers arguing a case before the Supreme Court over the next fifty years will be apt to cite cases which were brought to court during the last fifty years. The dusty old “LANDMARK” cases from the 1800s or early 1900s will always be valuable, and sometimes cited, but their relevance and impactfulness in the courtroom will become less and less.

So much for my presumption. But where to start in making my NEW list of the most important court cases for up-n-coming constitutional lawyers?

As a starting point, I decided to read several books concerning the currently sitting Justices of the Supreme Court, to see what precedents have been coming up over the last several years. For this purpose, I checked out a couple of books on the Roberts’ Court in general (Marcia Coyle’s The Roberts Court: The Struggle For The Constitution, and Tribe and Matz’s Uncertain Justice).

The next step, which I will not take until after my Self-Doctorate is completed, is to read these 500 or so court opinions, also taking note of what precedents are cited therein.  IMPORTANT:  I most definitely consider minority opinions just as valuable for my purposes as majority opinions.

The plan is to read fewer and fewer opinions the farther I go back in time, as they will (according to my presumption) become less and less likely to be relevant in the courtroom. Obviously, “Landmark” cases still being cited will make the cut.

Lastly, certain laws or acts seem to be worth knowing even in advance of any specific case-relevance, as they are so broad and so far-reaching, and some of them are still proving their relevance to numerous cases each year.  I’m thinking of Laws such as the Interstate Commerce Act or the Voting Rights Acts.
